Donna Mantin--Jade Winds Unit Owner? NOT!

Donna Mantin, LCAM 34445, former property manager at Jade Winds, sent out an email to some Jade Winds owners (including me) on 8 January 2015 announcing her purported unit ownership at Jade Winds.  

The full email message is below for your review, consideration, and enjoyment.

I will follow up soon with a complete rebuttal to this hubris and the so-called FACTS listed below.

Dear Neighbor,

I wanted to wish all of you a very happy and joyful New Year.

I wanted you to know that I am now a unit owner at Jade Winds and I am very excited, as well as dedicated to be able to help us reach a common goal towards the financial stability, quality of life, and safety for all of us.

I have received several questions and concerns from many of you, and I would like to clarify some of it.

Many lies and innuendoes have been said and written about past board members and myself.

The people who created those lies, manufactured and twisted the truth, were only motivated by their own agenda and dangerous goals.  Their self-serving goals will ultimately destroy Jade Winds, a community that the previous board and I have been working tirelessly to protect and make better.

I have been the property manager at Jade Winds working for First Service Residential since 2009. When the Board of Directors decided to terminate First Service Residential, in early October, I could no longer stay and continue as your property manager.

FACT:
Once my employer First Service Residential was terminated, I was no longer working for Jade Winds, therefore, any misunderstanding or confusion that I had been removed from my position by Jade Winds board is incorrect, and any board meeting held to vote to “remove” me was a sham and a lie.

Now, that I am a unit owner and personally invested, I am determined to investigate that everything is done properly according to Florida law. I am determined to spend every moment in defending our rights as unit owners, and make sure that we are protected and informed of every move and decision the board makes and why. 

FACT:
In the past 3 months since the departure of the previous board and myself, our property values at Jade Winds has declined by more than 15%, although throughout South Florida it has risen by 16.2%.

FACT:
In the past 3 months since the departure of the previous board and myself, documents have been removed from the office, late at night, and we should all be fearful that our personal information has been compromised.

FACT:
In the past 3 months since the departure of the previous board and myself, we can no longer come home and be assured that our assigned parking spaces are available.

FACT:
In the past 3 months since the departure of the previous board and myself, garbage is not being picked up on a regular basis, and rats are roaming about.

FACT:
In the past 3 months since the departure of the previous board and myself, parties are being held poolside, late into the night, with complete disregard for the Miami-Dade County rules concerning alcohol consumption, and the Rules and Regulations of Jade Winds. When something happens during one of these parties, it will be all of our liability, and we will lose the license, which allows us to operate and have pools.

FACT:
In the past 3 months since the departure of the previous board and myself, the buildings are no longer clean, trash sits for days in our stairwells, dirt and urine is in the elevators, and there is graffiti on our walls.

FACT:
In the past 3 months since the departure of the previous board and myself, some mailboxes have been vandalized, that warranted an investigation by the Federal Government.

FACT:
In the past 3 months since the departure of the previous board and myself, the management office is withholding our paperwork, which by law is mandatory.

FACT:
In the past 3 months since the departure of the previous board and myself, there was no State mandated Budget meeting, which according to our by-laws must be held in early November. We have not received our 2015 coupon books which should have been mailed in December, and we still do not know how much of an increase will take place.

FACT:
On September 26, 2014 the State of FL Division of Business and Professional Regulations ordered the Association to “re-notice the 2014 annual meeting and election to be held 75 days from the order”, which means the mandated special election should have taken place by December 11, 2014 and no later. We are now in violation of this court order, and can be held in contempt of court which is a very serious violation.

FACT:
In the past 3 months since the departure of the previous board and myself, several unsafe structure and code violations against the Association have not been addressed nor cured. Therefore, we will have to pay fines up to $10,000 per violation, which will cost us more than $150,000 in fines and penalties.

Jade Winds has been served with unsafe structure warnings, by the unsafe structure Board of the regulatory and economic division of Miami Dade County, by ignoring these warnings, the regulatory agency will demand us to vacate our apartments leaving us homeless.

A decision was made to have our Comcast cable eliminated, forcing us to pay approximately $65.00 more every month .When was this decision made, and by whom?. There was no properly called Board meeting, and the Board cannot make any decisions without giving the unit owners a chance to attend the meeting.  The cable service that we always had was always included in our maintenance payment, If they removed the cable service , the cable costs should be deducted from our maintenance fees.

They are not allowed to keep our money for cable if they are not providing us with cable.

In addition to the cable service which we pay in our maintenance, we also pay towards the use of the tower.  Since we cannot use the tower, that money needs to be deducted from out maintenance and refunded back to us.

I want to take this opportunity to apologize for my quick departure, since I know many of you wanted to wish me well and say goodbye. I am now here as your neighbor and am looking forward to seeing you and talking to you again. 

Since I am now your neighbor and a unit owner, I would love to help with any questions, problems or concerns you might have.  I am a licensed CAM, and have been a certified and registered property manager for over 33 years as well as an experienced member of BOD acting as president and treasurer. I am well versed and knowledgeable in condominium laws, rules and regulations, by-laws, 40 year-recertification, structural and electrical work, county codes and regulations and on and on and on.

I know that by joining together we can make Jade Winds a place it once was, and together, we can secure our future.

  1. While Donna was the CAM, I was denied the opportunity to view records, for three years. My parking spot, owned since the 80's was yanked from me, without notice, by Donna and the Board. Under Donna's regime, my car was illegally towed from my own spot, owned since the 1980's. Further, the terraces/balconies at EL, Daisy and Camelia are still unusable after (ongoing) three years. If Donna is so familiar with law and codes,why was the work in the EL parking lot done without permits, and proper votes by the residents? The closure of the EL/ Bamboo gates (even as pedestrians) is a safety hazard, and a violation of the Jade Winds constitution, mandating an entrance on 191st. St.

    If Donna was so knowledgeable abut condo law, why was the office mirrored at the expense of elevators, cracked and hazardous concrete, and unusable terraces in EL, Camelia, and Daisy?

  2. fact first time in years we have a functioning management office. Fact Its actually open in a professional business hours and able to take care of problems in a timely manner. Fact They actually have a smile on their faces as they doing so. Fact the security is polite and nice since Donna left instead of intimidating the unit owners.

  3. Donna, for how many years should we all be reimbursed for non-use of the tower? (This happened while YOU were the CAM.)
    For how many years should we be reimbursed for the inaccessability to our balconies? (At least three years). This also happened while you were the CAM.

  5. How did donna mantin aquire a condo in jade winds? What building is she living in? Did she buy it or just take it from us? I would love to see the paperwork on her purchace?
    I think we should all knock on her door and welcome her with the crap she created here! How is she even allowed on the property?

    There must be something in the water at jade winds because donna can not be forreal, nor can it be allowed talk about crappy neighbors, the neighborhood just hit a all time low, Hide your kids eyes the dont need to see her breasts hanging, plus a new rule was passed no dogs over 25 pounds, shes way over the limit and vicious, and should be euthonized

  8. Obviously, Donna Mantin has a very good experiencing lawyer and she wrote this letter following his/her advice. So, they've decided to use an aggressive defence and made this move of the knight - to blame a new Board. However, she's not taking into consideration the trend of developments. Board didn't depart. We have the same Board that was modified in quantity, but unfortunately not in quality. The same Board that worked with her for years (at least some of the Directors). The same Board that allowed her and Santiago Perez all of the horrible things that brought us to this mess. The same deaf, mute and blind Board. Since Donna left there wasn't even one new Director appointed to the Board. She states in her letter that "now" she is a unit owner. What does it mean? Did she become a unit owner recently, after her removal by the police from the premises? In this case, who provided the screening and let her buy a property here after an accusation (probably legitimate) of stealing of funds? Or, she bought it while she was in power and she had a blessing from her partner in crime Santiago Perez? Does our Management know about such an owner? Is she really on a list of Jade Winds owners?

  10. I moved from this place 6 mons ago and have yet to receive my security deposit from the office. I was told They were getting a new accountant. 6 months later and still nothing. I don't even have a working phone number for office. Any ideas?

  11. Welcome to the long line of folks waiting for any kind of refund. I'm still overdue my $2K "escrow deposit" which was due back to me last July.

    You know, I just had a strange thought. Suppose Donna Mantin didn't write that letter at all? It seems out of character for her to raise her serpent head. I think we should find out if it's even true that she moved in. Anyone can create a bogus email account and send out a message. Even she is not crazy enough to deal with the angry folks she left behind. And if she did purchase, then surely she doesn't plan on living here, just renting to some dumb fool.

    1. I think there is way to not let her rent out her unit. If I am not mistaken it's supposed to be some allowed percentage of the units in each building that can be rented out. In B-1 now more renters than unit owners. Still, how the Board approved her as a buyer taking into consideration her Jade Winds history?

  15. Donna is still comfortable on the 23rd floor of her Aventura apartment home. I actually didn't see the email until today. It does seem absurd to say the least.
    And as far as taking down the letter, if she had the balls to send it to many people, then there is not problem in even more people seeing it.

  19. As ignorant as Revital and Santiago were in thinking they would be able to get away with everything they've pulled, I'm sure they understand the possible ramifications of what they've done. In deeding his condos to Donna Mantin, Santiago is trying to save whatever assets he has from possible confiscation by the law. I'm going to be optimistic and hope our judicial system will see through his attempts to cover up what he owns.

    My only current worry is Donna Tollefson remaining on the board. It's no secret that she, Santiago and Revital were/are buddy buddy, playing tennis together and talking about the owners here as second class citizens. I was privy to a few conversations between her and Santiago and the tone was definitely one of close friends. About a year or so ago one of my neighbors approached her and inquired about the balcony work to which she laughed and replied that there's no money and my neighbor should get a lawyer. To me at least that sealed the deal that Donna Tollefson was fully aware of what was going on and was/is part of the fiasco after all she had been paying a reduced maintenence for quite some time as well. I would not doubt she is reporting back to Santiago on every step that is now taken and this to me can hinder not only the criminal investigation but also us moving on.

  21. These unit transfers are fraudulent because they do not have proper Association approval. This is yet another desperate and egregious act by Donna Mantin, Santiago Perez, and Revital Sharony to continue to exploit Jade Winds and a futile attempt save their 'ass'ets.

    The Board should denounce and discredit these shameful acts, lets see if they have the moral strength to do so....I doubt they will but I will be pleasantly surprised if they do.

  22. Yes, it does seem that the transfer was "fraudulent." But somehow that doesn't seem to matter. Is it just us, or is it a Florida thing that all of these unethical deeds that take place at Jade Winds, which blatantly must be in violation of some ordnance or law, slip under the radar with no consequence to the perpetrators? How long must we scream and shout about these unjust acts? Is there no governmental agency to step in and prosecute the thieves that took our money? How can it be legal that our buildings be left in disrepair for going on three years now? How can it be lawful that we be pinned inside our dwellings for three years with no access to our balconies, our own property?

  23. May anyone explain to me in a very plain English how could Board of Directors consist of even number of members? It looks like it will be 18 Directors. Who supposed to break a tie? Wasn't it specified in Bi-Laws that number of Directors cannot be less than 3 and more than 15? Am I missing something?

    1. Probably all the Directors before taking their assigned responsibilities must swear of having unanimous consent with the President on all of the questions. Always "pro", never "contra". Similar to what the previous Board did, and current Board does. I am just curious whether the remaining Directors will have some decency not to run for the Board this time, considering their previous history as the Board members?

Only unit owner will be allowed at the meeting on the notice, i guess we have really been taken over by dogs, when the oldest and least effective board of director allowed her dog to sit at the governing table, how much lower can this place get, think about, how desprite we all are to have some knodledge of whats going on here to subject ourselves, to hold a meeting in the dark( which is typicall of the board of directors, in the way of traffic, alot of questions asked and once again not answered, nothing will ever be accomplished in the dark, the only message put out loud and clear was we were frauded by the past manager and board( which seems to be the same board who did nothing about the last board but praise their good work and ethics!! And allow it to happen right under their noses!! All that was put out loud and clear was the manager needs a assistant. And our services are being cut, everything elce was hems and haws with robert graver rushing the manager to wrap it up, and the dog howling, and our neighbors trying to park in their spots put in a bad position,
    Take a good look at the governing table when someone flashed a light on it, nothing but empty shells of people, and not a paper or pen in their hands that my friends is what we are allowing, hands folded and heads bowed, they found a new puppet to protect their lack, of due dillegence, meeting is over their gone and we still in the dark!

  25. It looks to me that you're some kind of disappointed. Why? We had an opportunity to watch a free show called "Shame and Disgrace of Jade Winds Association" with the grand finale performed by the very famous actress and newly self-appointed Director, Ms. Alvarez. Haven't you enjoyed her performance with her well known "bang the fist on the table" trick? In regard to the dog's participation - who cares? One dog more, one dog less at the table wouldn't make any difference. Yes, we are allowing this totally disrespectful behavior. So, we've got what we deserve. I think it will be even darker at the annual meeting that suppose to be at the pool. Should we bring picnic baskets with us to watch another show?

Don't you realize that Sandra Fox is not the biggest evil nor some kind of black angel that extended her wings over entire community? Maybe it's time to open the eyes and see the bigger picture in proper perspective? Or, you are going to run for the Board and make a difference since you care so much and being cared by others?   26. Have anybody noticed that on the first page of the election package Management or the Board are referring to the Arbitration Case 2014-02-2455 and calling our regular elections as special. We've lost the status of special election and subsequent conditions for the special election when current Board decided not to do it, in spite of the Arbitrator's request. Now, Board decided to pick and choose from the Arbitrator's order whatever they want, even though the time for the special election expired in December, 2014. I have very serious doubts that Board obtained permission from the Arbitrator and/or Florida DBPR to modify/change the time and condition for special election. Are we going back to misinterpretation/falsification of the documents?

    Where are the receipts and deposits for all the parking monies collected?
    Where are the receipts for all the cash withdrawals made by Santiago Perez between April 2014-October 2014?
    What day did FirstService stop providing services to Jade Winds?
    Which Board member approved the transfers of units B1-214, 412, 413, and B3-401 to the Land Trust and Donna Martin (sic)
    On what date did the Board approve these transfer?
    Why were the unit transfers made at all?
    Who is Donna Mantin's target audience with her email sent on January 8? Obviously she believes she has friends at Jade Winds and is appealing to those people.
    Why did Donna Mantin bail out Jan Capote (MCorps security guard) in February 2014?
    How much did the lawyer fee for Jan Capote cost? His lawyer was super lawyer and celebrity attorney Mark Eirglish, why?

    1. You are absolutely right. Justice shall and will be served. The only question is: when? Unfortunately, our justice system is way too far from the well oiled machine. So, don't hold your breath. Meanwhile, I have the privilege (or should I call it punishment?) to see Donna Mantin almost on a daily basis in my building.

    1. This is a non lawyer answer and it is not legal advice....
      But if i paid a deposit (key word is deposit) to anyone or any corporation with the understanding that it will be returned after x time and it is not that is effectively some type of theft. I'm sure you have a good case for a claim for those monies. Exercise your rights for what is rightfully yours.

  30. I requested it when I first moved and six months later they "have no records of it" so I requested again. I have all the proof (copies of the check I wrote bank statements proving they were cashed and they said they received it recently but said "it's up to the board." Please advise as I have no understanding of the current situation reguarding the board as I no longer live there.

  31. The sad thing is that we cannot do anything. How could we allow the same people run the show after Donna and Santiago left? We had the State Arbitrator's request for special election to be completed in December, and we blow it. Now, our new manager calls our regular elections "special" (see his letter from 01/13/2015). And only G-d knows what kind of documents are being approved by the remaining Board, that has more than 1.5 months left in power.

  32. Dear neighbors! Maybe it's time to stop cursing Donna and Santiago and concentrate on upcoming elections? French historian and author of "Democracy in America" Alexis de Tocqueville said: "In a community association, members get the boards they deserve." It is crucial that only right people will get into the Board. I don't trust remaining Board members nor our new management. I don't really know whether lawsuits against Donna and Santiago were filed or not. Maybe the most trustworthy new Directors will create a special committee with the power of investigation? Unfortunately, I know for a fact (I am not quoting Donna) that some unit owners that supposed to be kept as far as possible from the Board are planning to run for the Director's seat. Let's be very careful, adhere to the principles and try not to repeat our previous mistakes.

  33. I'm beginning to wonder if there's anything that Jade Winds can do that won't turn out to be a complete circus. Yes we needed a new security company but the kind of protocol they are trying to do does not work for the layout of our driveway and guardhouse obviously. Once again we are creating a total hazard not only for the residents and guests but also for the local traffic. Once again cars are piled up all along the street waiting to come in. Are we waiting for a serious accident to occur? Because I can pretty much guarantee that's what will happen sooner or later.

    1. It was 7 (!) cars in the visitor's part of the driveway including one police car and about 6 or 7 cars standing inline completely blocking one lane on 18th avenue. Maybe it was the reason for police to come. It has to be some kind of solution for the condo as big as ours. What would we do in case of fire if only one central gate is functioning?

    2. Who hired the single digit IQ Security company? They are so slow and rude. Its enough the office is full of slow incompetent people who i would think by this time get their act together. They need a better system not blocking the whole 18th avenue. Residents cant get in either because of this. then they make the residents wait and lecture on not working barcodes? Seems typical Jade Winds Half ass management and Half ASS SECURITY...

  34. Have anybody read Donna's second letter? It's becoming a regular publication. I think it will be nice if our Board will learn from her and post a Board meeting Minutes like it supposed to be according to our By-Laws, as well as the State regulations.

  35. I thought that nothing might surprise me at Jade Winds anymore. Of course I was wrong. Yesterday I saw a woman accompanied by skateboarding teenager walking their schnauzer from Alamanda towards Bamboo. Everything was nice until the dog pooped right next to the Bamboo's parking lot. Obviously, this woman didn't have any intention to clean it after her dog. On the contrary, all three of them (two humans, or should I say one pig, one teenager and one dog?) made 180 degrees turn and went back to Alamanda. We were all complaining that management didn't provide us with the waste bags to clean after our dogs. So, now we have bags, but whoever didn't clean after their dogs continue doing so. Maybe these residents think that they are pigs and live in a pigsty? But I am not, and majority of my neighboring dog owners are not either. When people will learn how to live in the community setting? I am getting tired of these swinish tricks.

  36. I believe everybody remembers situation with Comcast last year. In spite of management's letter posted on our bulletin board we found out from the Manager's report distributed by the property manager on January, 22nd that Jade Winds has an outstanding balance with Comcast for more than 90 days. Now we have a sequence of this story. Yesterday I, among other unit owners, have received a letter from Comcast similar to the previous one. According to this letter our service will be discontinued on March, 9. Of course, I called Comcast and found out that our contract has not been renewed due to unpaid bills. What's next? Water and sewer? Garbage? Electricity? For how long we'll tolerate the lie coming from new management and old board? What kind of conspiracy they have? I recently found out from unofficial sources that some of the members of current illegitimate Board will be running again for the Director's position. What is wrong with these people? Do they have just a drop of decency after all they've done against the community? I realize that less and less unit owners are reading comments posted here, and this is very sad since this blog is the only way for us to communicate. However, we have to communicate in order for us to stop being unscrupulous and start doing something for the sake of our community. Or maybe we have to go to the psychic and find out who put the curse on Jade Winds (just a joke!)? I think that money that we'll spend on this psychic will not be wasted like our money for endless law suits and lawyers that we have no idea about.

  37. Talking about decency, at least Comcast is being decent enough to inform us about the situation more than two weeks in advance.
    Maybe our management has to go to Comcast for some kind of training and learn how to communicate with the unit owners on a timely manner?
    Also, is the management planning to make some kind of adjustments to our HOA fees, in case these changes will take the place in March? Does anybody know how much exactly we are paying for the cable service? Does any body have an itemized list of HOA fees?
    And the last but not least question - what does our current illegitimate Board think about it?

Besides the office being open normal hours but people I t it still useless and clueless. What's going on with Comcast they assured us everything was being taKen care of seems not Too far from old regime? Where is our high maintenance going too?

  39. So, another closed doors emergency Board meeting. I can understand that from time to time Board can have closed doors meetings. What I cannot understand why they didn't put an Agenda on this paper. Our management along with the remaining leftovers of dysfunctional Board have no idea about regulatory affairs and state requirements for Emergency meetings. They continue to be incompetent and arrogant. However, they, Board and management, are making some kind of decisions that we'll pay for the rest of our unit ownership. Are they going to disclose this "classified" information? At the end of the day Board and management have to understand that all decisions they make, they are making on behalf of entire Jade Winds Association, not on behalf of Board and management. I don't think we are moving forward. It looks to me that we are moving back, and not just moving but running back. In a few weeks or months we'll reach square one. Don't you agree that no professional management company will operate without the budget for almost three months? Or it's easier to play with our money without the budget?

  40. I am just curious who is supervising print out of the documents that were sent out as a part of the election package? First page of this package is dated as March, 27. Strange, as far as I know today is only the 4th of March. Just a human error? No, this is a pattern of work of our incompetent and arrogant manager. Also, how do you like the section that in order for us to enter our own storage bin we have to be supervised by the management or security guard. Furthermore, we have to make an arrangements with the management in order to go to the storage. What this manager used to run? Correction facility? In this case he supposed to know that he cannot pick and choose anything from the Arbitrator's order. It must be done with 100% compliance. How we can use the last year budget created by Donna Mantin and approved by the current Board? Our financial situation hasn't changed comparing to the 2013/2014 situation? What his agenda is? Is he going to follow steps of Donna Mantin? It will be wise for him to think about the end of her carrier here, at Jade Winds.

  41. Cars that belong to some of the Board directors are being parked on the another residents parking space. Why these Board members think that compliance with the properly adopted and certified in 2012 Rules and Regulations are not for them? According to the Management's notice: "Any vehicle parked in another resident's reserved parking will also be towed. No exceptions!". Will this rule apply to all Board members or they will be excluded, even though, according to the management, there will be "No exception!"? Should we hire a tow away company on a permanent basis? I think it will be cheaper than calling them almost on an hourly basis.

  43. I don't think it's ridiculous. It's a clear demonstration of the abuse of power by the property manager. Why the property manager thinks that he was hired to be a people's manager? Maybe it's good for his office but definitely not for the unit owners.

    Several yeas ago my mother- who has owned a unit here since 1968 decided to sit on the board because she had a lot of unanswered questions- I remember her coming home one night after a board meeting telling us that something seemed very fishy with Donna at the helm and that she did not want to be a part of this; she resigned- But before she did-I attended a board meeting with her at an off-site location-we got out of the car and Commandant Donna started berating my mother for not walking fast enough into the meeting; I mean yelling at her the way Nazi's yelled at Jews to get into the lines of selection at Auschwitz- I was appalled!! I walked over to her and told her that if she ever spoke to my mother that way again Id personally beat the crap put of her-( which was ridiculous because Im 115 lbs and she weighed at least a ton; ) I cold smell her toxic energy in her aura and told my mom you cant be around this kind of evil energy--It will make you sick--shortly thereafter she did resign---and shortly there after that--we saw the fall of her regime; still waiting to hear about the criminal penalty she has to pay--
